1. Introduction
Welcome to SandyCovePoint ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at sandycovepoint.sbs (the "Service") operated by SandyCovePoint.
By booking a charter or accessing our Service, you consent to comply with these Terms. If you do not agree with any of these terms, you are prohibited from using the Service.
2. Service Overview
SandyCovePoint offers a range of luxury yacht charter services which include:
- Day-long yacht rentals
- Evening cruises
- Business retreats
- Exclusive events
- Extended charters
Our services are contingent upon availability and climatic conditions. We maintain the right to alter or cancel services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For a successful charter booking, you must:
- Be at minimum 18 years old
- Provide truthful and complete details
- Make the necessary deposit as detailed in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
We only confirm your reservation after payment is made and we provide written confirmation. We reserve the right to refuse service at our sole discretion.
3.3 Availability
Charter availability is based on the suitability of the vessel and weather conditions. We will endeavor to honor your preferred schedule.
4. Payment Terms
4.1 Pricing
All our rates are expressed in € and encompass all applicable taxes unless stated otherwise. Rates are subject to change without prior notice.
4.2 Payment Schedule
- Down payment: 50% of the total cost of the charter required at the time of reservation
- Full payment: Required 48 hours before the scheduled departure time of the charter
- Additional charges (if applicable): Payable upon the conclusion of the charter
4.3 Payment Methods
We accept leading credit cards, electronic bank transfers, and verified checks. We utilize secure, encrypted platforms for processing payments.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled over 72 hours before departure: Full reimbursement minus transaction fees
- If canceled within 24-72 hours prior to departure: 50% returned
- If canceled less than 24 hours before departure: No reimbursement
5.2 Weather Cancellations
In the case of unsafe weather conditions, as determined by our captain, we will offer to:
- Reschedule your charter for another available date with no extra fee
- Issue a full refund if rescheduling is unfeasible
5.3 Mechanical Issues
In case of mechanical failure of the designated vessel, we’ll strive to provide an appropriate alternative. If no alternative can be supplied, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are expected to:
- Adhere to all instructions from the crew
- Wear any necessary safety equipment as indicated
- Disclose any medical conditions that might impact their safety
- Stay within the safe areas designated on the vessel
6.2 Prohibited Items
Certain items are not allowed on board:
- Containers made of glass
- Unlawful substances
- Weapons of any kind
- Non-prescribed drugs
- Pets (unless given prior authorization)
6.3 Conduct
Patrons must behave respectfully. Should passenger conduct cause a safety threat or interrupt the experience for other guests, we have the right to end the charter prematurely without a refund.
7. Liability and Insurance
7.1 Our Liability
Our liability is confined to the cost paid for your charter. We are not liable for:
- Injuries sustained due to passenger negligence
- Theft or damage of personal items
- Indirect or punitive losses
- Delays triggered by weather or events out of our control
7.2 Insurance Coverage
Comprehensive marine insurance is maintained on all our vessels and operations. Passengers should ensure they have their own personal and travel insurance coverage.
7.3 Assumption of Risk
By taking part in our charter services, you accept that maritime activities come with inherent hazards and you are responsible for your own safety and security.
8. Modifications and Itinerary Changes
We hold the right to adjust itineraries, paths, or schedules on account of weather conditions, security needs, or operational demands. We will make substantial efforts to offer a comparable alternative experience.
9. Force Majeure
We are excused for any delays, cancellations, or changes brought about by events outside our authority which include, but are not limited to:
- Extreme weather phenomena
- Calamities of nature
- Government directives
- Port blockages
- Vehicular malfunctions
10. Privacy and Data Protection
Your private data is processed according to our Privacy Policy. By engaging with our services, you give consent for your data to be collected and used as outlined in our Privacy Policy.
11. Intellectual Property
The content on our site, such as text, images, logos, and graphics, is secured by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our express consent.
12. Governing Law
